An unemployed Ocala man was arrested Thursday after allegedly violating conditions of an earlier pre-trial release.
Peter John Malcuit, 62, originally of Boston, was arrested after a Marion County deputy responded to a 911 hang-up call from a house on Almond Pass. When the deputy arrived and asked what happened, Malcuit said, “Nothing.” But a woman at the home told the deputy that she and Malcuit were arguing and that he had grabbed her arm to keep from her leaving, a sheriff’s report states.
The woman also said that Malcuit was drinking, which is a violation of his pre-trial agreement, the report says.
After seeing four unopened cans of beer in the home’s refrigerator and smelling alcohol on Malcuit’s breath, the deputy asked him if he had been drinking. Malcuit originally said he had not, but then admitted to drinking a watered-down alcoholic drink, which he identified as “one little Kahlua drink.”
Malcuit also told the deputy that he had argued with the woman and asked her not to go outside, but he denied touching or hitting her. He also said he was drinking so that he could calm down.
Malcuit’s bond and pretrial conditions from a prior battery charge in April state that he is restricted from threatening, assaulting, harassing or abusing the victim who tried to call 911, the report says, adding that he’s also prohibited from consuming or possessing alcohol.
When Malcuit was told to put his hands behind his back so the deputy could arrest him, he began yelling, “I didn’t touch her,” the report states. He also attempted to back away from the deputy and tried to leave the house through the front door. A struggle ensued before Malcuit was taken to the ground, placed in restraints and secured inside a patrol vehicle, the report says.
Malcuit was taken to the Marion County Jail and charged with battery, violating conditions of a pre-trial release for domestic violence and resisting arrest. He was held on a $1,000 bond.
