A former certified personal trainer at MVP Athletic Club tasered twice in July at Applebee’s has been rejected from a deal that would have allowed him to avoid prosecution in the case.
Justin Flood, 37, was with then-fellow MVP staffer Christi Cornell, 41, at the restaurant on Bichara Boulevard on July 25 when they had been asked to leave. They returned and Lady Lake police were summoned. Officers twice had to taser the 6-foot, 190-pound personal trainer who “violently resisted” arrest, according to the police report.
Flood hired criminal defense attorney Mark Conan who earlier this month negotiated a pre-trial intervention deal which would have allowed his client to avoid prosecution. Flood had originally been charged with a felony, but Conan had been able to negotiate the most serious charge down to a misdemeanor.
The terms of the pre-trial intervention contract required Flood to undergo an alcohol evaluation and seek recommended treatment, perform 25 hours of community service and to stay away from Applebee’s.
This past Wednesday in Lake County Court, a document was filed indicating that Flood’s pre-trial intervention deal has been revoked. The court file also shows that the revocation came after a memo was received from the probation department.
The memo shows that Flood was rejected from the pre-trial because of prior arrests.
Flood is due back in Lake County Court on Dec. 18 for sentencing by Judge James Baxley.
Cornell was also arrested on a trespassing charge. In August, she entered into a pre-trial diversion program that called for her to perform 25 hours of community service and to stay away from Applebee’s.
Cornell and Flood are no longer employed by MVP.
