A 44-year-old man is facing a felony charge of aggravated assault after allegedly swinging a bat at a retired sheriff in a dog-walking clash.
Brian Keith Caban, who resides in the Village of Springdale with his father, had been lying in his golf cart with his Cocker Spaniel, Tuesday evening in the parking lot of the First Baptist Church, according to an arrest report from the Marion County Sheriff’s Office.
A Villager who is a retired sheriff had been walking his Standard Poodle when it started barking at Caban’s dog. Caban attempted to leave the parking lot with his dog in the golf cart when the Villager’s poodle continued to bark and followed the golf cart. The retired sheriff attempted to stop his dog, when Caban allegedly yelled, “I will come back here and kill you.”
Twenty minutes later, Caban returned with a baseball bat. In the meantime, another man and his dog had joined the retired sheriff and were walking their dogs together on the church property. Caban began swinging the bat at the retired sheriff and it came so close, the retired law enforcement officer could reportedly, “smell the bat,” the report indicated. Caban was advised by the retired sheriff that he was armed.
The second man tried to calm things down, Caban went away and entered into a church building.
A Marion County sheriff’s deputy arrived on the scene and placed Caban under arrest on a charge of aggravated assault with a deadly weapon without intent to kill. He was arrested at about 7:30 p.m. and booked at 11:30 p.m. Tuesday at the Marion County Jail.
